12% unique has never been seen but theoretically it should work, but since legendary wasn't part of potential aside from the original 4th tier i could see why it wouldn't work.
The chance isn't to get a % higher than the maximum possible, it's to get a % that is part of the tier above it. So no, 15% legendary isn't possible.
