Anyone stabbed by it is trapped in a genjutsu for all eternity. Pretty cut and dry that it's a Genjutsu. At best you could argue its a taijutsu attack like all swords until you stab someone with it, I guess. Either way, it's not a Ninjutsu

And if he COULD absorb any chakra, whats your excuse that he didn't either time it would have saved his ass from Genjutsu attacks? Because he secretly wanted to die for the first time, and that kabuto didn't actually want to force him to absorb the totsuka's attack for the second?

Susano is a ninjutsu and the sword of totsuka is part of susano and can thus be absorbed. Just because it seals you in an eternal genjutsu doesn't mean the sword itself is. Also the taijutsu would then be kenjutsu. Why he doesn't absorb every attack that comes its way? Plot induced-stupidty that's why.
