Actually, it would. I highly doubt the phone is in the kid's name, or is even possible for it to be in his name. As a result, since the contract is in his mother's name, it is officially his mother's property.

The same applies to, let's say, my car. Technically it is mine. I have the keys, I drive it, I repair it, etc. But it is in my father's name. If he were to want it back for any reason, there is absolutely nothing I can do about it. According to the law, I do not own it in any way, even if I spent more money into it than my father has.
